There is also a separation of powers issue here. If Boehner wants to stop Obama from enforcing a law he can have Congress vote on specific legislation to do just that...but he cannot get his way because of the way our Democracy works....he would need veto proof majorities in both Houses.

Conversely if he lost the case it would codify Obama's supposed abuse of power, and thus strengthen Presidential power at the expense of the Congress.

Boehner is just throwing red-meat because of the fringe of the Republican minority in control of the Southern and Western US does not like having a black President.

I doubt if he actually files a suit.

I think Boehner is worse than the Tea Party because he is a moderate afraid to stand up to them. It seems like when he talks even he knows what he is saying is total bullshit.
