Cannot Impeach? Sue Obama?

Boehner plans to file suit against Obama over alleged abuse of executive power

I have no idea where this is going or if it is even possible. I thought the POTUS is immune from certain lawsuits and can only be impeached. Or is this an act of desperation due to OSD.

It'll fall flat on its ass. Just a way of the establishment to appease the 'Baggers after kicking their asses in the recent primaries.

Good point. See if Boehner actually does file a lawsuit or just blowing smoke.

Yep. Gotta agree with Ms. Pelosi.
"I make of it as subterfuge," she said. "They're doing nothing here. So they have to give some aura of activity."
Pelosi said the Republican caucus needs an "adult in that room." WaPo;)

First he has to prove there was abuse and that the President and C-in-C has had no authority to use the executive order.

Good luck.

No, first he has to prove he has standing to sue that defendant in that court for that reason. This won't make it out the gate. The Constitution provides the impeachment remedy and no other, and suits like this are routinely dismissed.

True. And the rightwing propaganda machine will use said dismissal as evidence of "liberal, pro-Obama bias" in the courts.

And their recently scorned base will eat it up with a spoon.
