Oh, please.
His reasons for the stop and search were well articulated, especially if a records check supplied him with her jacket.
It's not his fault she became belligerent before the search was over. That was just her acting entitled to break the law while operating a motor vehicle.
You know, her M.O.
Folks need better martyrs: like anyone who actually qualifies as such.

What I know is that it isn't against the law to be belligerent with a cop. And definitely not cause for a 4th Amendment violation by the police.
Far as I know "STFU and hand me my ticket, or if you want to keep spewing chunks from your festering piehole and tear up the ticket...I'll be happy to listen to your fucking lecture."....is not cause for a violation of anybody's 4th Amendment rights.

Zeke, I am sure that there are a lot of people driving w/o a DL, on a suspended license, no insurance, expired registration and so on. Why we carry insurance for uninsured motorists. How many get stopped and get thrown in jail unless there is an outstanding warrant?
The biggest challenge for large metropolitan areas is the impounding and storage of vehicles. Like these guys can afford or can pay to get their cars out of impound.

In this case, Encina's legal right to detain Bland as a law enforcement officer ended when he handed her the ticket. She was stopped for a traffic violation. He ran her for wants and warrants and came up empty. She did not commit an illegal act during the traffic detention...and detaining her for a nano-second after handing her the ticket was a violation of her 4th Amendment right to UNREASONABLE SEIZURE OF PERSON—DETENTION during a traffic stop. Smoking a cigarette in your car while you wait for the cop to write his ticked is not an illegal or threatening act.
But Encina didn't like her attitude. When he asked her if she was "...all right..." and then didn't like the answer he got...he was already in violation of her 4th Amendment rights. And he was further in violation with..."Are you done?" and then when he asked her "Do you mind putting out your cigarette?" Ordering her to get out of the car was the most blatant of his violations. He violated her 4th Amendment rights to be detained only as long as required to complete the serving her with the ticket.
Nobody owes a belligerent asshole cop like Brian Encina a nano-second of respect.
