Considering the vitriol aimed at Bush I'm surprised many lefties don't hate Obama because of the white part.

Prosecutorial discretion exists virtually everywhere for all laws. When the last time you got a speeding ticket for going 56 mph or arrested for tearing a label off a mattress? The INS has limited resources for arrests and deportations and focuses on those who threaten public safety. If there's a legitimate bitch about prosecutorial discretion, it should be directed at the SEC for allowing all the Wall St. miscreants to have a free pass to rape the country.
As for Scalia, I disagree with a lot of what he says and writes. However, I respect his intellect for a person that far right. Most folks that far right foam at the mouth while they rant and rave.

FDR tried to pack the court in the 30s when some of the New Deal programs were ruled unconstitutional....NRA and AAA. Probably the biggest misstep of his 12 year Presidency. Everybody remembers this and no one is going to even suggest any sort of removal or packing of the court with pro-administration judges.

It is a slow pendulum...for years it was a centrist-liberal court and for the last few decades more conservative. It may be swinging back toward the middle. Thursday will be a good indication of where it is going. Remember the party of the appointing President does not always indicate if a judge will be conservative or liberal. Ask Eisenhower lol......

Here is an example of what I wrote earlier, so far the administration has neither passed nor proposed an legislation regarding gambling, yet Sheldon Adelson says he will spend $100 million if it defeats Obama. This caused John McCain to state "The worst decision by the Supreme Court in the 21st century. Uninformed, arrogant, naive." Finally something McCain and I can agree on.
$100 million, gotta hate real bad to spend that kind of money.
