But those are the goalposts. The only question is which direction we desire to lean.

Why isn't this a case of false arrest?
Any escalation was initiated by the cop including asking her to put out the cigarette. He should have asked her to do this first (if it is considered a weapon ) before he approached her and then he may have a case.

I'm not missing your point Zeke. I don't give a shit about your point.

She's a victim Zeke. Civil juries love poor depressed victims driven to suicide. So we will see.

I suspect there was no way in hell a jury would have acquitted OJ...eh Zeke?

I do find the overt emotionalism in this thread...odd.

1. Stop was legit.
2. She escalated.
3. Behavior demanded jail.
4. She committed suicide.

I don't see the issue beyond her selfishness.

In theory you can question rationale for police work across the board but this is all within current accepted parameters.

I administer the MBTI and always tested as ENTP. But as I've gotten older I find I make fewer and fewer decisions based on logical and analytical examination of cause and affect...more and more on what feels right. So I've self identified as ENFP.
