Will Obama sue Trump for libel (or is it slander)? He's been accused, with zero evidence, of treason; far worse than the birther nonsense, which brought this idiot national notoriety.
Something must be done to prevent this clown from embarrassing the office and our country further, and destroying our alliances with democracies around the world.

Where is the outrage from the Democrats on this for Trump's disparaging of Obama, or even the Presidency? 
To answer your question, I believe that Obama's being silent on this is better. If he speaks up or takes any action, the GOP will turn this into an Obama scandal. Now Trump owns it and no one is on his side.

Twittering counts as publishing, I would think, so it's libel.
The legal remedy is impeachment, to 'make America respectable again.' But that won't happen yet.
Meanwhile, I'd love it if Obama would 'call Trump out' rhetorically. Excoriate him totally for saying what he did and having nothing. Stand up to the bully. That generally works very well, and it would in this case I think.

I might be outraged if it weren't so laughable. I also wonder if Obama could sue. Even if he did and won, could he prove damages. If I were on the jury I would want to give Obama a zillion dollars, but in good conscience, I doubt I could even award him $1. This would be because I would be hard pressed to see Obama damaged by such a ridiculous comment and source, I doubt many people if any really took it seriously. Especially now with the current evidence provided.

The distinction between slander and libel no longer exists. It used to be that libel was written and slander was spoken, but now both are known as defamation. Publication is a requirement, but publication occurs if defamatory words are spoken to another (besides the person being defamed).

I think it could be a class-action suite, as everyone in the country is damaged by having a visible ass for a president. I think $10 each for 100,000,000 plaintiffs would be a moderate and appropriate result.
