Our family doctor delivered hundreds of babies until the cost of malpractice insurance forece him to quit in the late eighties, so he was unable to deliver our eldest which was our wish. We needed some help and worked with a highly touted infertility specialist / OBGYN in the area who helped us and delivered our second in '90. Just 2 years later he stopped delivering due to the cost of insurance and out 3rd and 4th were not able to be delivered by either of the doctors we preferred.
Every field now charges/spends a huge percentage covering their asses against lawsuits, and this has to be addressed.

Justice = money. At least that's what the malpractice lawyers around here say on their commercials.

Adopt the idea where whoever loses the case pays everybody's expenses. And license some of these so called "experts" they bring in to testify. Capping the awards is unfair to people who really are victims of malpractice, but there should be someway to convey to people why they call it the "practice" of medicine, they don't have all the answers. Saw two doctors on Newhour regarding the Giffords case. They admitted that for 400 years they assumed a damaged brain could not heal, now they are suddenly finding out that it can. The case of the child here recently where the had to remove one side of her brain to stop violent seizures, the other half eventually takes over.

I understand the appeal of that position Rob, but consider its practical effect. The only ones capable of bearing the risk of litigation are going to be the well heeled. That would make it that much easier when dealing with a business that has ripped an individual off to say, "screw you, sue us if you want." There's always the possibility that they will come up with a loophole to "justify" their action.
Moreover, much of the information necessary to fully investigate a claim is in the hands of bad actor. The only way to force access to such information is with a lawsuit and the discovery process that is part of such litigation.
All that such a rule is likely to do is to further protect the propertied class from justified claims. Individuals would have to choose between recovering for economic and/or physical harm or being exposed to the risk of total economic annihilation.

Well it seems to work in Canada, back in the early 1900s my Dad lost his right leg just below the knee in an industrial 'accident'. Except that it was not really an accident because the chain they were using to hoist this large pipe had a defective link. Dad sued and won and he was by no means a wealthy man. So there must be summat else screwed up in the system.

In today's world, without some slick, big city mouthpiece like Don in his holster, the court would simply tell him that he doesn't have a leg to stand on!!!

BTW Don, whenever I worked at the pool table factory, a shaper kicked out a big splinter, and it went right though the operators, well...thing.
Do you think you could have handled that for him???

Kinda like the guy who got his trouser snake bitten by a real snake when he was taking a leak.
His buddy called emergency medical on his cell. The nurse told him that he would have to suck the venom out of the bite marks.
After he got off the phone the one with the poisoned peter asked his buddy what he found out.
