The bigger issue is Trump's refusal/lies/obstruction concerning the return of the documents. Criminal intent seems pretty clear in Trump's case but much less so (if at all) in Biden's case.

B.S. alert!! They "belonged" not with Biden at all. Let me help you just a bit:

https://www.archives.gov/presidentia.../1978-act.html. The act states that: The United States shall reserve and retain complete ownership, possession, and control of Presidential records; and such records shall be administered in accordance with the provisions of this chapter.

There are exception processes built into the law, but please find for me anywhere in the regs that state that the documents "'belonged' where the VP at the time placed them." Let me help you. Its not there.

Espionage and mishandling classified documents are two entirely different things.

Here is a comment from an attorney who does only national security work elaborating on the point I made:

The problem with constitutional officers (Executive, Legislative, Judiciary) never getting any real security training with respect to handling classified documents is they have no real sense of what the rest of us deal with on a regular basis. They are exempt from all this.

Good, principled decision by AG Garland. The Special Counsel and the US Attorney in Chicago who did the preliminary investigation were both Trump appointees, so wingnut whining about the selection and subsequent decisions should be muted (though they rarely let facts get in the way of their whining).

Speaking of wingnuts spewing shit, here's Ronny Jackson (R-TX) says he believes that the Biden docs that were found are part of a conspiracy by Democratic operatives to set Biden up and force him to resign because they don’t want him to run in 2024.

Contrast Garland's alacrity in appointing a special counsel for Biden today with Barr's outright refusal to appoint one to look into Trump's criminal attempt to extort Ukraine. Also interesting is that it took 557 days in Trump's case but only 71 days in Biden's for DOJ to appoint a Special Counsel after discovering the mishandling of classified documents. It sounds DOJ is being weaponized against Biden. I'm sure Gym Jordan's new committee will get to the bottom of this.
