Judge Neomi Rao’s opinion in In re: Michael T. Flynn is simply astonishing.

It involves the Justice Department’s surprising decision to drop charges against one of President Trump’s former top aides — nearly three years after that aide plead guilty to lying to the FBI. And Rao’s opinion takes extraordinary liberties with the law.

Her opinion asserts jurisdiction over a case that Rao’s court has no right to hear. It relies on a rarely invoked process that the Supreme Court described as a “drastic and extraordinary remedy” that’s “reserved for really extraordinary causes.” And it keeps a trial judge from hearing arguments that Rao and one of her Republican colleagues, Judge Karen Henderson, apparently believe that the trial judge shouldn’t even be allowed to ponder before making a decision.

Nor is Rao’s opinion in Flynn out of character for the recently appointed jurist. In less than two years on the bench, Rao has repeatedly handed down opinions benefiting Trump and his aides that rely on highly dubious legal reasoning.

The only saving grace of the court’s decision in Flynn is that Rao and Henderson are far-right outliers on the United States Court of Appeals for the District of Columbia. There is a chance that the full court — which has the power to reconsider Rao’s opinion even if no party requests such a reconsideration — will toss Rao’s opinion in the trash.

Rao’s opinion is an exercise in outcome-driven sophistry that barely pretends to be a judicial opinion. While gutting a vital check of executive misconduct, Rao whitewashed the Justice Department’s flagrantly political decision to drop charges against Flynn—hours before the House Judiciary Committee heard whistleblowers testify about political interference at the DOJ, including in Flynn’s case. Rao accused the district court of “unprecedented intrusions on individual liberty” simply because it dared to “prob[e] the government’s motives” for meddling in the prosecution of the president’s ally.

Wednesday’s decision by the U.S. Court of Appeals for the District of Columbia Circuit will almost certainly be appealed to the full court and possibly the Supreme Court after that. If upheld, Rao’s ruling will set a terrible legal precedent. But equally devastating are its broader, long-term implications for judicial independence.

In his forthcoming memoir, former CIA director John Brennan reveals that President*-elect Donald Trump [repeatedly tried to avoid blaming Russia during a classified briefing in January 2017 on the Kremlin’s interference in the previous year’s election.

“It could have been the Chinese,” Trump asserted on several occasions, according to Brennan’s book.

After he and three other leaders from the intelligence community “took turns debunking his counterclaims,” according to Brennan, Trump sought to cast doubt on their sources and methods. “Anyone will say anything if you pay them enough,” he purportedly said.

“I stared at Trump, shook my head in disgusted disagreement and bit my tongue nearly hard enough to draw blood,” Brennan writes. “It was one of the few times in my professional career that I successfully suppressed my Irish temper when dealing with a politician. I wish I hadn’t.”

Fast forward three-and-a-half years. During an interview on Tuesday, Trump said he has never raised U.S. intelligence that Russian bounties have been offered to Taliban-linked militants to kill American troops in Afghanistan during any of his conversations with Vladimir Putin, including a call with the Russian president last week. Trump demurred when Axios’s Jonathan Swan asked whether he believes the U.S. intelligence assessment that Russia was behind the deadly program. Instead, just as Brennan says he did at Trump Tower, the president* pivoted to China.

Cast doubt. Precisely what the idiot Trumpkin trolls here try to do with each and every post. Ignore them.
