I received this in an e-mail yesterday. It is another interesting way to look at why Comey did what he did.
"This is interesting. The Former FBI Agents Association is suggesting that members watch Director Comey's testimony tomorrow."
[As I reflect on this, it could be brilliant strategy by Comey. If the Bureau had recommended to move to criminal charges, they would have had to: 1) Clam up... nothing could be said as it would be an on-going investigation, and 2) Had to watch from the sidelines as DOJ probably would have failed to produce an indictment, or slow-walked the matter through the election cycle.
Instead, Comey released a statement with bare facts yesterday, which is a precedent. He is now being compelled to testify before Congress, where further facts will be revealed under oath. In other words, he is trying Hillary in the court of public opinion without her having the opportunity to defend herself.
He is, in effect, releasing the full findings of the investigation much sooner than feasible by any other legal method and without being tainted by allegations that the investigation and conclusions were biased by politics. I think this was made possible when Attorney General Lynch inappropriately met with Bill Clinton. This is his quid pro quo. "You can't touch me, because you're compromised."
Fact is, if Hillary had been indicted, I think Biden would have been a walk-on next president, preserving the White House for the Democrats. Now it's in play in spite of (or maybe because of) Trump.]

ICE, having served, you can't tell me much about the UCMJ I don't already know. And even under the UCMJ, there are marked areas of safe cover for O-4s and higher. It is just how the system works.
There is a marked difference in the subject matter and sensitivity between military need to know and diplomatic need to know.

The precedent is big fish aren't prosecuted to the letter of the law. Just small fish, to punish them for other misbehavior or make examples of somebody.
For any of several possible reasons, Cormey wasn't prepared to break precedent.

IIRC, he said so at the hearing so your deduction is spot on.

Thought the decision was based on "intent".....

It was but the statutes she violated cover crimes of negligence and don't require intent.
