Time had a good article on these cases in the latest issue, unfortunately I cannot seem to find a link to it.. Regardless the author pointed out something that has bothered me in these threads here. Opinions have, for the most part, been just too simplistic and it by no means was all black and white, life rarely is.

As for this -- or any other act -- being "intentional," I'd saw that you possess very little legal or definitional knowledge. If John Q. chokes someone out during another's commission of a crime via the application of a trained non-lethal maneuver which accidentally causes death? The fault remains with the offender, not John Q.

If they do not comply with a lawful instruction? You use the level of force required to subdue them, in a heartbeat. Then, post compliance, you assess. Mental state guesses prior to situational control is cowboy work. (And, as an aside, let me guess:you DID find out the difference between personal and public property by virtue of trying to obtain legal representation claiming you were somehow harmed by an officer doing his job. )
