It matters more what the IRS and the USDOL think, and the gov't has significantly stepped up enforcement in this area. It's been an issue not just with "gardeners and laborers". It's always been an issue in the construction industry, but it's also becoming more and more a challenge as businesses try to classify employees as contractors rather than employees in consulting jobs in areas like IT, Finance, Marketing, etc.

Cheaper to hire subs than it is to add employees to the payroll.

Lets get back to Obamacare and how nonsensical Obamanomic relates to 2.5 million 40 week jobs loss is better.

How is the Quality of Life of Americans going to be better with less take home pay? Working less hours?

When the gripe is that employers don't pay enough as it is.
All the while Goods and Services cost more and more everyday.
Anyone holding a job will loose more dollars earned to even more federal taxes imposed.
Which will reduce the middle classes buying of all goods and services.
Which will reduce sales at the local economy
Property taxes will go up to help cover local and state governments.

I can go on and on because it's a snowball effect.

Not just our GDP will suffer but the worlds GDP will.
