Generally speaking it is the organization itself that can be sued. And remember what happened to the Rodney King cops. They were exonerated in criminal court, but they didn't prevail in the end.

Edit: I just read the article. Why is it always people struggling with cops? Why did they have to taze him twice? This is ridiculous. Choose your battles, folks. Cooperate with the police and handle it with your attorney later. This is not complex.
