BTW, adding 'if it can be shown it put him over the top' changes the question, and is immaterial. Say Tony needs $100,000, so they raid Burnie's place one night. If they only get $80,000, but Tony gets the other $20,000 somewhere else, does Bernie say 'never mind?'
