Actually he lets them put the cuffs on him. I do not see him fighting his way out of anything. Where does he try to run away or beat up a cop or take a weapon?

I'll admit it is awhile since seeing the cellphone video. But do remember him batting away their attempts to subdue and assistance was then used.

No not really.

If you are in the custody of police it is their job to protect you as well as detain you. When he was being held in a chokehold on the ground and said he could not breath the humane thing to do would have been to listen to him, turn him over, relax the hold and let him breath.

He was not resisting arrest then.

OK after much effort to view the complete video. Being it is pull by copy right by the Daily News. I see a struggle with resistance. Arms going up batting away the officer in front attempting to cuff him. Repeated saying "why don't you just leave me alone". I see an office doing the choke hold. I agree the officer should of not used this method. Now could the struggle from then on was because of the victims having medical issues. Maybe the case. But saying I can't breath the officer should of let go once on the ground. Big problem area for him with me. Medical assistance should of been call for that is where I see the faults accruing also.


But I still say the victim was resisting arrest. He did not deserve to die for it either. Tough call and a tragic event. Overreaction by the officers maybe but just what the charges should be is not my place.


But just like what military personnel do or don't do in the heat of battle I'll defer to ones experienced. Because never been forced to make those choices and really can't tell for sure how I would of reacted. I gladly let those who have experiences with events like this make the judgments.

Once bitten twice shy. The officer shouldn't have used the choke hold, but letting go of one who resisted isn't happening.

Jesus Christ Pete, there were already at least a half a dozen other cops holding the guy down. It wasn't like the dude was going anywhere if he relaxed on the choke hold.
