The Judge CAN'T let him off on a technicality, wouldn't dare. He/she'll be forced to do legal backflips to prevent it if one arises, and therefore would actually subvert our own system, in the name of some nebulous idea of fairness.

Hope we don't have to go to war, the courts would get busy
