Certainly, that could cast a pall over any shots fired outside of the car.

There are relatively few -- but a couple are huge caveats -- situations where shooting a fleeing suspect (and that's the legal classification here, post scuffle) is justified.

Well I am confident that if an entrance wound in the kids back does make it into the autopsy report you will find one of those caveats.
