A judge in Delaware has ordered a jury trial in Dominion Voting Systems’ blockbuster lawsuit against Fox News, setting the stage for one of the most consequential defamation decisions against an American media company in decades.

Delaware Superior Court Judge Eric Davis rejected Fox’s attempt to throw out the suit ahead of trial, and he ruled that Dominion has proven the first elements of their defamation claim: namely, that the network’s statements about Dominion and the 2020 election were false.

But he ruled that a jury must decide whether Fox operated with actual malice.

“The evidence developed in this civil proceeding demonstrates that is CRYSTAL clear than none of the Statements relating to Dominion about the 2020 election are true. Therefore, the Court will grant summary judgment in favor of Dominion on the element of falsity,” the ruling read.

The network’s lawyers have defended the conservative cable news company on First Amendment grounds, saying the claims being made by Trump and his allies were newsworthy.

“Even if the neutral report privilege did apply, the evidence does not support that FNN conducted good-faith, disinterested reporting,” Davis wrote, also rejecting Fox’s other First Amendment defenses.

The court found the various statements made by Fox hosts and guests about the election were, in fact, false. The issue now is whether Fox knew they were false or acted with reckless disregard of whether they were false. It appears that Fox News is bigly fucked.

Between Trump's indictment, Fox/Dominion lawsuit news and this wingnut being convicted, it's a bad Friday in MAGALand. Tucker Carlson regularly advocated for Mackey since he was arrested. Mackey has expressed white supremacist beliefs and he concocted a scheme that tricked people into believing they could vote via text. He targeted Black women specifically.

New Shareholder Lawsuit(s) against Fox News

A Fox Corp shareholder alleged in the lawsuit that Murdoch and four board members failed to stop Fox News from reporting falsehoods about the 2020 U.S. presidential election that damaged its credibility.

At least two firms have said publicly they were investigating potential breaches of fiduciary duty by Fox’s board across both lawsuits.

The Berger Montague law firm issued a notice March 6 that it was opening an “investigation into Fox’s board of directors for potential breaches of fiduciary duties to Fox and Fox’s shareholders” in the Dominion case.

Scott+Scott Attorneys at Law LLP has opened an investigation against the the company and its board for a potential breach of fiduciary duty, in the Smartmatic case.

More Fox News Lies (to a judge, no less)

In the Dominion defamation case about Fox News knowingly lying to its viewers, it appears that they also knowingly lied to the presiding judge. They could end up in even deeper shit than they already are in.

The judge overseeing Dominion Voting Systems’ massive defamation case against Fox News said Wednesday that he plans to appoint an outside attorney to investigate whether the right-wing network lied to the court to withhold key evidence, after repeatedly expressing exasperation and frustration with Fox’s attorneys.

“I am very concerned… that there have been misrepresentations to the court. This is very serious,” Delaware Superior Court Judge Eric Davis said Wednesday at a pretrial hearing in Wilmington.

The extraordinary move, on the brink of the trial starting next week, is the latest blow to Fox News as it tries to fend off the $1.6 billion defamation lawsuit that Dominion filed in the wake of the 2020 presidential election.

The Judge Eric Davis has sanctioned Fox News for their withholding information and lies.

Are the Fox attorneys such rank amateurs lying in court on a matter that can easily be verified.

On the other hand the Judge Eric Davis seems to be enjoying mocking Fox and their attorneys a bit too much to the extent he may be prejudicing his case.

There is still a risk (to the sane) that Dominion will settle this out of court and Fox's sins and lies will be buried forever.

Oh Oh, does not sound good from my vantage point.

The presiding Judge Davis has notified of a delay of one day in the Dominion Fox case, possibly due to last minute negotiations on a settlement. If this case does get settled, the entire Faux episode will be buried, which will not be a good outcome for our democracy.
