The most common enforcement mechanism for Fourth Amendment violations is the exclusionary rule, which renders evidence obtained during an illegal search inadmissible. In this instance, the search isn't for evidence but for a fugitive, so the exclusionary rule is not much of deterrent. While there can be civil liability for a Fourth Amendment violation, in the absence of some extraordinary police misconduct in the context of the search for the bomber, I don't see that happening either.

A GOP state senator from NY has suggested torturing the suspect to get information from him. When called on the idea, he doubled down on it. Sad thing is that millions will agree with him.

I suppose he figures it makes him all the more appealing to the GOP base, notwithstanding the fact that the kid is in the hospital with a bullet through his neck and leg. Dipshit.

I suspect there are plenty of amputees from his actions who would be more than happy to assist in the water boarding.

Yeh, so? That doesn't make it any more legal or effective, particularly on a guy who can't talk anyway because of a bullet hole through his throat. I suppose a lot of right wing knuckledraggers think that waterboarding is an effective treatment for a bullet hole through the larynx.

Well, supposedly he's providing information via pen and paper.
I don't give a crap if they play charades or blink eyes to get the info, and I don't care if the sick little bastard suffers so we can get it.

I guess that makes you a tough guy with as little respect for the law as the kid himself.

Law? Surely you jest.
All that's required is for Obama to decide he's the enemy, and assassination approval is granted.
Oh that's right, water boarding is abhorrent and can't be compared to killing.

Again, the law and order party is so willing to trash the law.
