Yes. Being a cheat, being a liar, being gay, being a smoker, being a Jew, being black, being white, even being 5 below. Because they don't have to disclose why the employee was fired. If the employee decides to file a wrongful termination suit, they may be forced to disclose the cause in court. They will lie, of course.
The way the law works in this country now...you're taking an enormously bigger legal risk giving a former employee a negative referral than you are for firing the same employee for being gay or having an abortion.
