There have been lots of loaded questions popping up here in the last few days. The "do you still beat your wife?" reference earlier was to the use of loaded questions. I think I had confused the concept of the loaded question with the concept of the "negative pregnant." It seems that some of the loaded questions posed here have been designed to bring about a negative pregnant, which the questioner will then exploit.

The loaded question is not permissible in a legal proceeding, because it is designed to mislead rather than to reveal the truth. I would suggest that we engage in a voluntary moratorium on this sort of misdirection. We all have a tendency to sing to the choir here. That tune can very easily end up off key.

Well thanks D-Ray, that's as good an explanation as I've heard and better than I'd have come up with.

For anyone not keeping score, I found some of Krazygrll's comments about the President were very much along the lines D-Ray is talking about. I tried to explain to her why it was misleading to try to make a point as she was, especially when using such poor references to "back up" her accusations. When she became obstinate, refusing to believe she was being anything other than fair, I realized logical argument wouldn't work, so I came up with a way to demonstrate why it was wrong.

For the record, I don't think she's a terrorist (or at least I didn't before she said she was. No. Stop that!) I was just making a point. You can find all kinds of circumstantial evidence for something, and merely suggest that it is so, exactly as she was doing before. Then, when confronted, you can simply say "I never said that!" But it doesn't make it any better. It's a cheap and intellectually dishonest way to try to make a point.

Class dismissed.

The problem with a loaded question is that one may use it even without a hint of circumstantial evidence to back it up.

"Is Obama still a Muslim?"

"If he didn't write any papers, why did he conceal them?"

"If he doesn't have to produce his medical records, why doesn't he go ahead and do it?"

"If you were telling the truth, why did we have to water-board you?"

"If he doesn't intend to practice law any more, why hasn't he paid his bar dues?"

"If she asked the court for permission to take inactive status, why did the court enter an order granting inactive status?"
