If you are the one who decides whether or not an email is government or private, as was Hillary as the head of the State Department, you cannot go to jail for deleting any email you have deemed private. No. If she deleted stuff that is subsequently deemed to have been government business, she broke the law regarding maintenance of government records. If it comes to light that she delighted classified material, it will further show she maintained classified records incorrectly. Both are crimes.

Wait and see.
