The OJ Simpson grand jury never even knew that OJ had a set of gloves that had blood splatters on them. The OJ Simpson prosecuter did not know that the gloves did not fit OJ's hands well.
There are very few grand juries that go against what the DA is pressing for, or the converse as well.
And most grand juries are not provided with all the facts. They are given a set of Clif Notes, and then vote to proceed with issuing the charges. In a case like this, where there is a dramatic change in the physical proximity, and then in level of physical threat present, a grand jury will not be allowed the advantages that an oppositary trial has as one of its greatest strengths.
