I'm not exactly confident in civilian court either, when the charges are "use of a WMD". If we get confirmation they were connected to Al Qaeda and they add on a treason charge, I'll be more comfortable. I'm sure they'll probably sentence him to death, but there's a lot of opposition to corporal punishment in this country. Where does it creep to? In another 20 years, they'll be letting people like this out on parole after 6-8 yrs.
In this case, given that the alpha subject is deceased, there's probably not that much to learn through enhanced interrogation. One day we may get a main player, but precedent toward civilian court will limit our options if he's a citizen.
