'Is the Senate in session right now' is the question. Obama would have to have the Senate in recess to do a recess appointment without a vote.

The Republicans were using 'pro forma' maneuvers to keep the Senate permanently in session, to guard against this. Involves having one guy on the floor every day, I think. It does occur to me that if a number of Democratic senators were to unexpectedly show up, they could move adjournment, a vote on which could only be delayed by a quorum call. If the Democratic majority on that day stayed a majority by the end of the role call, they could vote adjournment, giving Obama his chance.
