Story contains spin in that they state that this is the crucial decision and only certain 'ancillary but necessary' matters are left for trial. That 'ancillary' description is misleading in my opinion. Left for trial is the question of actual malice, a legal stipulation that states that speech regarding a public figure on a public issue cannot be found defamatory unless the speaker acts with actual malice, which is narrowly defined. This is not an ancillary matter because the case is won or lost on it.
