It was illegal under the ages-old and never used Logan Act which likely wouldn't be used the first time for this (prosecutors only like to take slam dunks to trial). That notwithstanding, it definitely goes against the established standards of American governance that we only have one President at a time and Flynn was effectively telling Russia to ignore (Congressionally-supported) sanctions enacted that day (which they did a couple days later by not retaliating, to everyone's surprise at the time).
Flynn told FBI investigators what he told Pence (that he didn't discuss sanctions) and
it appears he committed a felony. However, you can be sure that that little dweeb Sessions won't enforce this law either.
