If you are the one who decides whether or not an email is government or private, as was Hillary as the head of the State Department, you cannot go to jail for deleting any email you have deemed private. It may not be the best or most transparent manner of doing things, but legally one cannot charge Hillary for deleting emails she had the power to deem private.
