I read Capehart's column.

The fight in the car analysis is interesting, but in the end not on point. Brown was not fatally shot at the car, and whatever he did at the car does not justify shooting him while he's trying to flee, or surrender.

That said, I accept Capehart's and the DOJ analysis of the witness statements regarding what transpired when Brown was killed. Brown was advancing on Wilson, and did not have his hands up. If we accept that as the case, the shooting is justified. I said exactly this a long time ago, but I've not heard persons whose opinions I respect come to that conclusion, until now. It is an opinion call, based on analysis and weighing of contradictory witness statements, not on forensic evidence.

However. There is a final 'however.' If Brown turned around because Wilson was firing at his back (and missing), then THOSE shots were criminal acts on the part of Wilson.
