ACLU filed a lawsuit on this in 2008 and lost in the SC just this year.
So let's wait for the outcome from this recent lawsuit.
A person in this country is a criminal only when convicted of a crime. From what we know, no person from NSA has been convicted of a crime yet unless Snowden volunteers.
