'N.Y. appeals court refuses to delay Trump fraud trial set to start Monday' WP

"NEW YORK — An appeals court Thursday declined to postpone the start of next week’s trial in the New York attorney general’s $250 million fraud lawsuit against Donald Trump and his company.

The appellate court had been asked by Trump’s legal team to put off the scheduled start of the fraud trial Monday and to force New York Supreme Court Justice Arthur Engoron, who will oversee it, to dismiss claims that the defense says are improper because of the statute of limitations." "Fulton County Superior Court Judge Scott McAfee on Friday denied a motion by former Trump campaign attorney Kenneth Chesebro to toss out emails and memos he wrote detailing a plan to use a Republican slate of electors in Georgia and six other swing states won by Democrat Joe Biden.

Chesebro’s lawyers had argued that the documents were protected under attorney-client privilege and should not be used against him in the sweeping election interference case brought by Fulton District Attorney Fani Willis. In an order issued Friday morning, McAfee said those protections are only meant to shield lawyers who are not suspects in a crime, and he referred to the defense motion as a “strained reading” of Georgia law.

McAfee wrote that documents accompanying a search warrant that turned up the memos “repeatedly refers to the Defendant as a ‘co-conspirator,’ ‘participant,’ ‘intermediary,’ and ‘liaison’ working with several other charged defendants in this case to further a ‘false elector plot’ in violation of several laws.”

The documents — which include emails to co-defendants John Eastman and Rudy Giuliani — are important to the state’s case against Chesebro and include a Jan. 4, 2021, email to Eastman that “outlined multiple strategies for disrupting and delaying the joint session of Congress on Jan. 6, 2021,” according to the indictment."

One way to win a case is to ask the judge to throw out the evidence. Good if it works.

ATLANTA — A defendant in the sweeping election-interference case against former president Donald Trump and 18 others in Fulton County, Ga., became the first to plead guilty on Friday.

Scott Hall, a 59-year-old bail bondsman from the Augusta area who prosecutors alleged played a wide-ranging role in efforts to overturn Trump’s loss in Georgia, pleaded guilty to five counts of conspiracy to commit intentional interference with the performance of election duties. The charges are felonies that were reduced to misdemeanors because of Hall’s status as a first-time offender.

Hall agreed to serve five years of probation and, importantly for the prosecution’s case, will testify.
