Trump is not immune in 2020 election interference case, appeals court rules
https://www.nbcnews.com/politics/sup...fer-rcna133234

WTF took them so long to come to this glaringly obvious conclusion!?

I'm betting they wrote their unanimous and detailed 57-page ruling to be so convincing that SCOTUS will not grant a certiorari petition (i.e., they'll let the appeals court decision stand and won't hear the case).

Here are some choice excerpts from the court's ruling:

For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant. But any executive immunity that may have protected him while he served as President no longer protects him against this prosecution.

During President Trump’s 2021 impeachment proceedings for incitement of insurrection, his counsel argued that instead of post-Presidency impeachment, the appropriate vehicle for “investigation, prosecution, and punishment” is “the article III courts,” as “[w]e have a judicial process” and “an investigative process . . . to which no former officeholder is immune.”

It would be a striking paradox if the President, who alone is vested with the constitutional duty to “take Care that the Laws be faithfully executed,” were the sole officer capable of defying those laws with impunity.

We cannot accept former President Trump’s claim that a President has unbounded authority to commit crimes that would neutralize the most fundamental check on executive power—the recognition and implementation of election results. Nor can we sanction his apparent contention that the Executive has carte blanche to violate the rights of individual citizens to vote and to have their votes count.

^^And while the justices wrote "For the purpose of this criminal case, former President Trump has become citizen Trump.....", operative word being criminal, Trump's House allies are doing an official whitewash of his attempted insurrection.

Quote:
“Resolved, That it is the sense of the House of Representatives that former President Donald J. Trump did not engage in insurrection or rebellion against the United States, or give aid or comfort to the enemies thereof.”
Too bad that this resolution if passed will not have any legal weight but Gaetz and Stefanik have risen to the occasion and drafted this resolution. For Gaetz this could an "honor among predators" moment, but Elise? Probably trying harder since she is not on Trump's short list that we know of.

Well, this hearing is going about as expected. The "strict textualists" are only strict about the clear text of the Constitution when it suits their biases. Sad.

^^Using the excuse that one state cannot decide a candidates fate in all other states is a lame excuse while avoiding to decide whether Trump fomented an insurrection. Back to let the courts decide except every case is hamstrung with appeals and delays.
Justice is swift my ass.

Down the road I see him declaring there needs to be a do-over of the election he just lost. Claiming all the prosecutions and biased media caused him to lose because of election interference.

Anyone else notice that none of Donny's attorneys in none of his cases are trying to get to trial ASAP so they can "prove" his innocence? Not a one.

Trump’s first criminal trial will start March 25, judge says
The schedule for Trump’s hush money case in New York means he will spend weeks in court instead of on the campaign trail this spring.

Let's hope his courtroom antics will, quite deservedly, put him behind bars, or at least get him muzzled during the trial.
