Regarding the thread topic, I'm pretty sure the rule of law is being followed and having court judges appointed by the party in power is part of this.

Pretty much yes.
It's a catch-22 with judges, sheriffs, and such being being elected or appointed. One way is a popularity contest du jour, and the other spoils of political dominance du jour.

Fortunately we have the flesh and blood authors who wrote this ACA legislation to quiz, which is what the 4th circuit in Richmond accomplished.

As to your infallible and godlike 'founders', correct me if I'm wrong but their bones turned to dust long ago Pete.
