Muslim Ban Loses in Court
Federal appeals court tells Trump and Prez Bannon to stuff it on their Muslim ban.
"A federal appeals court has maintained the freeze on President Trump’s controversial immigration order, meaning previously barred refugees and citizens from seven Muslim-majority countries can continue entering the U.S.
A panel with the U.S. Court of Appeals for the 9th Circuit upheld the ruling of U.S. District Judge James Robart, who had decided Friday that Trump’s temporary travel ban should be put on hold. The Department of Homeland Security soon suspended all enforcement of Trump’s controversial directive." WP

As predicted and the question now is when they will appeal to the Scotus, before or after the 9th judge is in place. I predict they will do it now especially since 55% of Americans support this ban. So even a predictable loss is a win.

It will be interesting to see what the administration does. SCOTUS will over turn the Ninth. Just a question of whether they want to waste any powder on it. Would be simpler just to ignore the courts like Obama did. It is not like they still can't keep those people out the same way Obama let anybody who wanted to sneak across the southern border stay.

It would not be a waste of powder and its an issue that needs to be settled. The lower courts have stepped into territory that the SCOTUS has traditionally held is well within the constitutional authority of the president. The issue needs to be settled.
Robart and the Jesters at the 9th Circuit have over-stepped. In their ruling, the assumed the authority - not provided to the judiciary under the constitution - to determine that the refugees didn't pose a national security threat. Agree with them or not, they don't get to make that determination.
The Government has pointed to no evidence that any alien from any of the countries named in the Order has perpetrated a terrorist attack in the United States. Rather than present evidence to explain the need for the Executive Order, the Government has taken the position that we must not review its decision at all. We disagree, as explained above.

Sadly, this situation is playing perfectly into Trump's hands. Everything is a political game. He doesn't actually care about keeping out immigrants or this ban, he cares about consolidating his power. The best possible outcome for him would be to appeal the decision and have it be upheld by a 4-4 court. That way, he can scream and moan about judges with an agenda while propping up his nominee as a needed voice of reason.
His supporters will side with him on the issue regardless of what the courts or logic says, so this "loss" in front of SCOTUS will only de-legitimize the Court in their eyes, and will give a reason for Trump to start undermining court decisions with the backing of his followers.
Facts and reason are no longer working, and I'm not sure what it will take for Trump supporters to wake up.

Trump is playing a high risk, high reward game. He is attempting to leverage the goodwill he does not have to reinforce his power through fear, and media manipulation. Witness his masterful management in getting the media to list every terrorist attack they have covered worldwide over the past two years, just by saying they have neglected their coverage responsibilities.
He perceives any terrorist attack on US soil as a validation of his power, even though he is at the same time delegitimizing the intelligence and security agencies that are tasked with preventing such attacks. Whenever one does happen, he isn't going to provide any additional resources to stop such attacks, he is going to grab as much additional power as he can. Reichstag, anyone?
By messing with the judicial system and intelligence/security agencies, Trump is attempting to consolidate power in his own hands. In the long run, this will not work, as Trump's modus operendi in the business world leads to chaos, money disappearing, and brand bankruptcies. The same will happen within the federal government.
I am counting on the 10% margin that, in reality, has decided all the Presidential elections since Bush/Dukakis. You may be able to cow/fool/flummox/flimflam them for a year or two, but slowly they will(hopefully) have their blinders removed. As they do, the election balance will tilt slowly to the Democrats. Warren is the first to recognize and begin deploying an effective strategy to counterbalance Trump, and she will not be the last.

Problem is that the Democratic Party headed by Pelosi and Schumer has very little credibility with the people (bet less than Trump at this stage) and whether this has rubbed off on Warren, only time will tell. My fear is that they will take every opportunity to grandstand and vilify Trump which helps them with their constituents while not working very well for the party in the long run.
There must be a movement first to banish these ineffective corrupt leaders.

Trump is a one trick pony, note that although he got elected so did 98% of the incumbents. People want change? Yeah sure.
