Donald Trump is in danger of losing his favorite trade weapon.

The president argues he is allowed to impose tariffs on other countries' steel and cars because they pose a threat to America's "national security," but that position appears increasingly hard to justify after a bombshell ruling set to be adopted at the World Trade Organization on Friday.

The Geneva-based body will set a very high bar for countries to invoke the controversial Article 21 "national security" justification to impose trade restrictions. Although the decision refers to a Russia-Ukraine border dispute, the implications are likely going to be much wider since it's the first time the WTO has ruled on the powerful security clause.

Trump has become the most prominent advocate of Article 21, telling other countries they can't challenge his steel and aluminum duties (as well as potential auto tariffs) because they fall under the national security exemption.

The WTO ruling, however, sets a high threshold for invoking the security clause. It cites the need for an "emergency in international relations" that must be essentially linked "to the 'hard core' of war or armed conflict." In the case at hand, the judges saw this requirement as fulfilled — given an armed conflict in eastern Ukraine — and allowed Moscow to impose security restrictions against Kiev.

I often said during rallies, with little variation, that “Mexico will pay for the Wall.” We have just signed a great new Trade Deal with Mexico. It is Billions of Dollars a year better than the very bad NAFTA deal which it replaces. The difference pays for Wall many times over!

Only Trump and his minions would be too dumb to realize that most "foreign made" vehicles sold in the United States are actually assembled in the United States. If you really want to know if your car is "American", look at parts content and point of final assembly. You will soon realize there is no such thing as a purely "American made" vehicle anymore. Furthermore, Chrysler is owned by Fiat, an Italian company. So the adage "Well, at least the profits stay here...." doesn't necessarily hold water, either.

The problem for Trump is that to punish China, he must punish Americans first. He’s already doing that with the tariffs he imposed last year. Economist have pegged the cost of Trump’s tariffs at $3 billion per month — and those are new taxes paid by Americans, not by foreigners, as Trump keeps mistakenly insisting.

Trump’s tariffs have also led to retaliatory tariffs on U.S. exports to China, Europe, Canada, Mexico and other countries, which are hurting American farmers and some companies. Trump may think the U.S. economy is strong enough to absorb a few billion dollars in tariffs — but that’s not OK with the people bearing the cost, or their political representatives.

Republican Sen. Charles Grassley of Iowa, who chairs the Senate Finance Committee, said recently that Trump must remove all tariffs in order for Congress to ratify the new trade deal Trump negotiated with China and Mexico. Grassley wasn’t addressing China, but the Chinese surely noticed that Trump’s own political party is resisting him on tariffs. Republicans have also introduced legislation that would make it harder to impose tariffs for national-security reasons, a tactic Trump used last year for steel and aluminum imports and has threatened to use for imported automobiles.
