The point really is that many presidents, going back for more than a century, have interpreted the recess appointment provision as permitting their use during any time Congress was out of session. It's a reasonable interpretation but one that the DC Circuit disagreed with.
The issue may not yet be resolved. The Administration, or some future administration, may decide to appeal the CD Circuit's decision to the Supreme Court.

Just because I love to argue, I will assert that this thread hasn't wandered so far that it couldn't get back. We are still talking about what to do about a crazy regime that posts videos with not so subtle threats of annihilating NYC. The OP would suggest such a discussion, except to the extent that someone tries to get it off track by calling Obama a commie.

Personally, I think we still have one foot in North Korea. We only got sidetracked because BS saw an opportunity to try to lump our president in together with a foolish little madman in North Korea. Despite that we've managed to keep the focus at least partially on the OP. Do you have anything you'd like to add to keep things going?

Deify their words, but attempt to hide or downplay their true actions (Slavery, Whiskey Rebellion, Trail of Tears, Manifest Destiny, etc, etc.) and make up sanctimonous fairytales of unflinching honor and impeccable charactor. Then transpose your ideology onto the persona of these quazi-fictional charactors. (Conservapedia and the Texas School Board, anyone?) Few will then dare contradict one who speaks of these dead demigods. After all, they recieved their guidance from the Alighty, himself, did they not? "If God be with us, then who dare oppose us?"---right?
