I see your point, but all theories are not created equal. A prosecutor's theory of a crime must be carefully constructed to serve a prosecutor's purposes, that is, to account for all known facts and to point the way to looking for further evidence leading to either a prosecution or a dropped case. A conspiracy theory need have no great correspondence to facts, but must provide a satisfying/entertaining myth for the believer, and thus, with continued elaboration, continued loyalty and support from them for the creators.
