Michigan Ballot Proposal 2 - Unions

Can someone please explain how Michigan Ballot Proposal 2 jibes with federal labor law?

Michigan Ballot Proposal 2 proposes to amend the state constitution so that it guarantees employees the right to organize. Wouldn't such an amendment be preempted by federal labor law?

I took a labor law class in law school but that was almost fifteen years ago and I never used the knowledge.

Here is a bit on the ballot proposal.

Thanks.

It's largely about 2 major issues for the union folks:

Giving them the same bargaining rights as private sector employees

Assuring Michigan never becomes a right to work state

Thanks, whell. That article brings up an issue that I had not considered. Namely the ability for city and county governments to decide what is best for their community vs. being dictated by state law.

What a f*cking mess. If there was enough honest work to do there would be less of these sorts of battles.

I'm a lawyer and am having trouble figuring this stuff out. How regular voters are supposed to understand it is beyond me. The state attorney general is of the same opinion.

Quote:
Michigan Attorney General Bill Schuette released a legal analysis of the measure stating that it was too complicated for the ballot and could not be accurately described to voters in the summary with its limit of 100 words. This analysis was part of the debate whether or not to place the measure on the ballot to be made by the State Board of Canvassers.

I'm leaning against this amendment.

IMO it is a job creator for lawyers and taxpayers will foot the bill. Workers won't see jack squat of a benefit.

Me thinks you're right. It's likely also, the reason that the unions are spending some cash on ads that support it.
