Well that is open to debate, I recall when I was still living in Canada, the tomato lobby here (remember the Hockey Brand, tasted like hockey pucks) kept out Mexican tomatoes because they were not all this uniform size that could be packaged in lots of four. So the Mexicans simply shipped them stright through to Canada, damn good tomatoes, large and vine ripened.

After all, a patent is really a licensed monopoly. An overly broad grant of patent protection has the effect of rationing products that could have social utility.
