Kyle's 'intent' was not akin to a random mass killer's 'intent'. Almost the exact opposite.
The first guy he shot wasn't just mouthing off, he was approaching Kyle with the apparent intent of disarming him. Kyle was running away, didn't point his weapon until the guy ran at him.
Kyle intended his gun to be a deterrent. Instead it made him a target.
